The process begins with a representation being filed before the President, which is then referred to the ECI for an inquiry. The ECI conducts its inquiry under Section 146 of the Representation of People Act, 1951, equivalent to a trial in courts.
During this inquiry, the ECI exercises its powers to issue summons and record evidence. Following the inquiry, the ECI sends its recommendations to the President regarding disqualification. The decision can be challenged in the High Court or Supreme Court by either party.
